Kevin Cundiff, a former deputy with the Delta and Ouray Counties Sheriffs' Offices, and a former Delta Police Department officer, finds himself on the wrong side of the law. He has been charged with sexual assault on a child and sexual assault on a child by one in a position of trust, both of which are class three felonies.
Because of Cundiff's ties to local law enforcement agencies, the investigation was conducted by the Colorado Bureau of Investigation at the request of Delta County Undersheriff Mark Taylor.
According to an arrest affidavit filed in Montrose County, Cundiff allegedly assaulted a young female from the time she was 7 years old until the age of 12, when law enforcement was conducted. The offenses occurred at two rental homes on B Road in Delta County, and most recently at a home in Olathe.
According to the arrest affidavit, the 12-year-old recently began saying she didn't want to be left alone with Cundiff. When asked why, the young girl said Cundiff looks at "dirty pictures" on his cell phone. After additional probing, she described a number of sexual acts that allegedly took place over the past five years.
The Delta County Sheriff's Office was contacted on July 29, and after an initial investigation the case was turned over to the CBI.
