The Hotchkiss Town Council on Aug. 15 unanimously approved an ordinance to ban commercial marijuana enterprises within town limits.
Town attorney Jim Briscoe opted for very specific wording in the ordinance.
It states, "... As an exercise of its local land use authority, that such marijuana cultivation facilities, marijuana product manufacturing facilities, marijuana testing facilities, and retail marijuana stores shall not be located within the corporate limits of the town."
Included in the ordinance is a glossary of terms related to the marijuana industry.
The penalties for violating the ordinance are a fine of not more than $999, imprisonment in the county jail for not more than one year, or both. Each and every day a violation occurs is considered a separate offense.blog comments powered by Disqus
