Jim Briscoe, town attorney, brought a draft ordinance for the Hotchkiss trustees to review. The ordinance would ban any type of marijuana operation within town limits.
The wording in the draft ordinance states, "No suitable location exists within the corporate limits of the Town of Hotchkiss for the operation of marijuana cultivation facilities, marijuana product manufacturing facilities, marijuana testing facilities, and/or retail marijuana stores' licenses." All of the above facilities or operations would be prohibited within town limits.
The draft ordinance also includes penalties. A violation would have a fine of not more than $999 or imprisonment in the county jail for not more than one year or both. Each and every day a violation happens will be a separate offense.
"The Town is specifically authorized to seek an injunction, abatement, restitution or any other remedy necessary to prevent, enjoin, abate, or remove the violation, and any remedies provided for herein shall be cumulative and not exclusive, and shall be in addition to any other remedies provided by law or in equity."
The draft ordinance includes a list of related definitions.
The matter will be on the agenda for the next town council meeting Aug. 15 at 6:30 p.m.
