A default judgment issued by the Delta County court on a wrongful death complaint may be reversed because the defendant received improper notice of the suit. According to a published account, an attorney for Dr. Sam Jahani says his client never received proper service of the pro se complaint filed by John Moore of Cedaredge. Jahani never received proper notice of the complaint and therefore did not respond by the deadline, and the default judgment was entered by the court. Jahani has asked the judgment be set aside. Moore reportedly has withdrawn the original complaint.
