| Hinchman wants trial to resolve license dispute |

On Thursday, July 16, Steve Hinchman, a lifelong resident of the Surface Creek Valley, and owner of Hinchman Orchards, pleaded not guilty to charges that he was in violation of Title 5 of the Cedaredge Municipal Code by not having a business license. He is opting for a court trial to resolve the matter.
Chapter 5 of the Municipal Code requires the registration of any and all businesses doing business within the Town of Cedaredge. The licensing requirement became effective Jan. 1, 2007. Hinchman lives outside the incorporated limits of the Town of Cedaredge and, in addition to the orchard, operates Hinchman Construction. Hinchman said in November 2008, he paid the town $22,000 for a building permit, which included the water and tap fees, to build a duplex on N.E. 4th Street. Hinchman was given the permit, but the $22,000 fee did not include the $25 needed for a business license. Now completed, the duplex remains empty because, according to Hinchman, the town has refused to give him a Certificate of Occupancy, pending a survey of the water line used to irrigate the golf course and until he pays the $25 for a business license. In an earlier interview Hinchman said, "No matter what you call it, the business license is just another tax, and I'm fed up, and I'm not going to pay it, even if I have to quit doing business with the town." At that time Cedaredge town administrator Kathleen Sickles said Hinchman was the first business to be cited for failing to purchase the required business license. Hinchman's next court date is set for Thursday morning, Aug. 27, in the Cedaredge Municipal Court, starting at 9 a.m.
