On the afternoon of Tuesday, Nov. 21, 32 headstones in the Delta City Cemetery on 3rd Street were knocked over. Tony Bohling, City of Delta parks supervisor, says the vandalism was discovered by a citizen walking through the cemetery around 4:30 p.m.

Delta Police Chief Luke Fedler's fears were realized Nov. 4, when Parker police officers shot and killed Michael Marin, 35, of Montrose, during an exchange of gun fire.

Marin was identified as a suspect in the robbery of the Arby's restaurant in Delta Oct. 14.

Arby's robber is still at large

At about 9:50 p.m. Saturday, Oct. 14, officers of the Delta Police Department were dispatched to a robbery reported at Arby's, located at 107 Gunnison River Drive. An extensive search of the area was conducted and the suspect was not located.

The suspect was reported to have walked into Arby's and after a brief conversation with an employee, was able to leave the store with a small amount of cash and coins.

Velarde sentenced to 3 years in prison

On Monday, Oct. 2, Tia Velarde was sentenced to three years in prison after pleading guilty to distribution of methamphetamine, a class three drug felony, in Montrose County.

Velarde also received concurrent prison sentences after previously pleading guilty to attempted introduction of contraband and driving while ability impaired in case 17CR91 (Montrose), possession of a controlled substance in case 16CR282 (Montrose) and possession of a dangerous weapon in case 16CR150 (Delta).

On Thursday, Sept. 14, the Delta County Sheriff's Office executed a search warrant in the Peach Valley area of Delta to search for and arrest Gina Sander, 29, who was actively wanted on two felony warrants. Sander was located and taken into custody without incident by investigators.

Felony filings see 'unprecedented' increase

Delta County is on track for what district attorney Dan Hotsenpiller calls an "unprecedented" year-to-year increase in felony criminal filings.

Felony stalking conviction draws 3-year prison sentence

On Friday, July 28, Shawn Willshire was sentenced to three years in prison after stalking and "terrorizing" a young mother over a 14-month period.

District Court Judge Steven Schultz imposed that sentence, plus an additional three years of parole, after rejecting a previous deal in which Willshire pleaded guilty to trespassing.

Elderly woman bilked of $85,000

An investigation launched in April 2016 has resulted in the arrest of a South Carolina woman who obtained over $85,000 from an elderly Delta resident.

The Delta resident was told she had won several million dollars in a lottery, but would need to send money to cover taxes and other expenses before claiming her prize.

Judge rejects plea deal for Shawn Willshire

Although he does not generally reject plea agreements, District Court Judge Steven Schultz did just that last week when he refused to accept a plea of guilty to trespassing entered by Shawn Willshire. Instead, Willshire will stand trial for felony stalking.

Judge Schultz made the unusual decision after listening to a lengthy statement from the victim, who said she could not agree to dismissal of the stalking charge, or to the stipulation to two years in prison.

The Delta Police Department has issued a warrant for the arrest of James H. Catlin, 31, of North Quincy, Mass., charging him with vehicular homicide in the Feb. 6 accident that resulted in the death of Gladys "Josie" Varela.

Catlin also faces charges of vehicular assault, unlawful use of a controlled substance, driving under the influence (alcohol), driving under the influence per se (alcohol), driving under the influence (drugs), reckless driving and reckless endangerment.

Appeals court upholds ruling on pesticide drift

The Colorado Court of Appeals has upheld the conviction of a Hotchkiss area rancher who drew objections from his neighbors when his pesticides drifted onto their property.

James Hopper was found in violation of a contempt order, sentenced to two days in jail and ordered to pay a fine of $7,500. The appeals court affirmed that ruling.

Juvenile convicted of sexual assault on a child

In the Delta District Court Wednesday, Jan. 4, the Honorable Steve Schultz entered an adjudication of a juvenile after a four-day trial. The court determined that the evidence sustained a finding, beyond a reasonable doubt, that the juvenile committed the crime of sexual assault on a child as a pattern of abuse.

Yager to be retried; DA adds first degree murder charges

In late 2016, the Colorado Court of Appeals overturned the conviction of Nathan Yager, who is serving a prison sentence for the murder of his estranged wife, Melinda, in Paonia in 2011.

Yager pleaded not guilty by reason of insanity, but the insanity plea was taken off the table just prior to closing arguments.

The Colorado Court of Appeals has issued an opinion reversing the conviction of Nathan Yager, who is serving a prison sentence for the murder of his wife Melinda in 2011. Yager pleaded not guilty by reason of insanity, but was convicted of second degree murder after a jury trial in November 2012.

A stabbing in June 2015 has led to a six-year prison sentence for Pablo Saldivar Jr. of Delta.

Saldivar, 21, pleaded guilty to that incident, as well as an altercation with a fellow inmate last spring while he was being held in the Delta County Jail.

Local man convicted of securities fraud

Colorado Attorney General Cynthia Coffman announced last week that Daniel Lee Holding of Delta County was sentenced to five years in prison and ordered to pay restitution in the amount of $93,564.06. The sentencing, which took place in Mesa County District Court, comes as a result of Holding's plea of guilty to securities fraud, a class three felony.

A Cedaredge couple awaiting trial for cultivation and distribution of marijuana has again been arrested.

Delta man held at gunpoint, knifepoint in 'bad drug deal'

A Delta man who was ordered, at gunpoint, to give a ride to his two attackers instead sped away in search of help shortly before midnight Aug. 8.

The 58-year-old North Delta resident was spotted speeding south on Main Street and was pulled over by DPD Officer Everett Neil after he blew through a red light at the intersection of Highway 50 and 92.

Zhane Ware sentenced to youthful offender program

"Frankly, most defendants would not have received that kind of offer [from the district attorney]," Judge Steven Schultz said at the conclusion of a sentencing hearing in Delta District Court July 18.

But because Ware has no criminal history and is just 19 years old, the DA's office, defense attorney James Clark and the judge agreed the sentence is appropriate.

A recent crime spree that spread from Paonia to Delta and involved four law enforcement agencies resulted in the arrest of Curtis Allen Gomez, 36, of Grand Junction. As of Tuesday morning, Gomez remained in custody in Delta on multiple cash bonds and faces multiple charges from all four agencies.

Law enforcement shuts down credit card operation

On Thursday, June 23, the Delta County Sheriff's Office with the assistance of the Delta Police Department, Cedaredge Police and multiple federal agencies, executed five search warrants in Delta and Mesa counties, four of which were executed in the Delta, Eckert and Cedaredge areas. The search warrants were a culmination of a cooperative investigation between local agencies and DEA into a group of Cuban nationals that were involved in credit card fraud and cultivation of illegal marijuana in both counties.

Sometime between midnight and about 2 o'clock on the morning of Monday, May 23, vandals broke windows at two businesses located in the 200 block of Grand Avenue in Paonia. Aaron Weedman, 22, of Delta is facing a number of felony charges after crashing into a Montrose residence with a stolen vehicle.

The incident unfolded during the early morning hours of May 7, when Weedman allegedly jumped the fence at Hot Water Productions and stole a service truck, using the truck to smash through a gate before driving off.

Thanks to a tip from a horn-buying business in Grand Junction, and subsequent followup by the Mesa County Sheriff's Office, investigators from the Delta County Sheriff's Office were quickly able to solve a theft from a taxidermy business in Paonia.

On March 23, at about 9 a.m., the sheriff's office was notified of a burglary at 530 Grand Avenue in Paonia.

Lauren Mann's Facebook page continues to receive tributes and remembrances after the 25-year-old former Paonia resident was found dead in her apartment in the Austrian capital of Vienna.

Officials in Vienna have determined Mann died of suffocation. Her death is being investigated as a homicide.

Cedaredge homeowner assaulted; two arrested

On Jan. 28, the Delta County Sheriff's Office, with the assistance of Delta Police, Cedaredge Police and the 7th Judicial Drug Task Force, executed a search warrant on two homes located at 821 Grand Avenue and 821 1/2 Grand Avenue in the city of Delta. Two individuals, Albert Romero, 26, and Alejandra Moews, 26, were arrested on arrest warrants related to the search. Other arrests are pending.

Cedaredge man held on pot charges in Nebraska

The Lancaster County Sheriff's Office reports the arrest of a Cedaredge man, 68-year-old Steven McElmury, for possession of marijuana with intent to deliver.

McElmury was arrested Thursday, Jan. 21, after a sheriff's K-9 indicated the odor of narcotics coming from McElmury's 2014 Dodge Ram pickup, which was found unoccupied in a business parking lot in Lincoln, Neb. The pickup had been observed driving eastbound on Interstate 80 a few minutes earlier.

Cattle rustlers strike in Cimarron

Montrose Regional Crime Stoppers and the Montrose County Sheriff's Office are seeking the help of citizens to locate and apprehend the perpetrator(s) involved in the following incident involving the theft of cows and calves from a corral in Cimarron.

On or about Oct. 10, person or persons unknown stole 18 cows and 71 calves from Forest Corral on Cimarron Road in Cimarron.

Hotchkiss fire, theft remain unsolved

Two incidents that occurred in Hotchkiss early in the year remain unsolved.

According to Marshal Dan Miller, cause of a March 8 fire at Tucker's Pizza, Pub and Arcade, 221 W. Bridge Street, suspected to be arson, remains under delayed but active investigation by the Colorado Bureau of Investigation.

The calls were generated Thursday, Nov. 19, shortly after officers of the Delta Police Department responded to a robbery at the Western Convenience Store at 15th and Howard.

Cattlemen offer $5,000 reward

The Colorado Cattlemen's Association and Delta County Livestock Association are joining forces in search of the individual or individuals who have shot calves to death in the Black Mesa grazing allotment.

Since late September, three dead calves have been discovered, two with small caliber bullet holes and one shot by a large caliber rifle.

Dr. Sam Jahani, 52, faces up to four years in prison after pleading guilty to a single charge of conspiracy (controlled substance violations, health care fraud violations and/or money laundering violations).

Jahani was initially charged with multiple, individual counts of those numerous violations, and was accused of causing the deaths of three patients through the practice of overprescribing.

Pastor sentenced for child abuse

Ironically, his continuous denial played a factor in the four-year prison sentence handed down by Judge Stephen Schultz.

At the Oct. 27 public meeting, the Paonia board of trustees voted unanimously to approve a stipulation for entry of judgment related to the civil suit filed in October 2014 against former town finance officer Kristin Chesnik, who has admitted to embezzling hundreds of thousands of dollars from the town treasury between 2007 and 2011.
