Please reprint this letter I wrote to Senator Kerry Donovan and other state representatives:
As a retired Colorado State Patrol captain, I was appalled when I read and looked into HB 19-1177, known as the "Red Flag" law. I strongly urge you to vote against this bill when it comes before the State Senate.
HB 19-1177 is 33 pages of a very poorly written attempt to deprive lawful gun owners of their Second Amendment rights. As a student of history, it reminds me of Nazi Germany prior to World War II, when its government became a police state!
No law enforcement officer, police agency, judge or anyone else should have the kind of power HB 19-1177 is proposing and it is a clear violation of the Second, Fourth, Fifth and 14th Amendments of the U.S. Bill of Rights. It will waste countless tax dollars on endless lawsuits, and will endanger law enforcement officers attempting to enforce it, before it is declared as unconstitutional by the state or U.S. Supreme Court.
You and I have both taken an oath to support and defend the Constitution of the United States and the State of Colorado. As my elected state senator, I expect and request you to do just that and vote "no" on HB 19-1177 or any other bill that violates our constitutional rights.
There are plenty of laws already in the state statutes to address mental health and unlawful gun use -- we need to just strictly enforce them.
I also am ashamed of how low the Democratic Party fell to pass SB-181 during a blizzard, while those who might oppose the bill couldn't get to the capitol to vote!
What kind of dirty politics is this? The people of Colorado overwhelmingly voted "no" on the very same kind of energy-killing question only four months ago on Nov. 6, 2018.
