Former town trustee Bill Brunner will be reimbursed for legal costs related to a 2017 lawsuit filed against him in Delta County Court after being denied a records request under the Colorado Open Records Act.
The decision was made on Dec. 27 at a special meeting of the town board of trustees, called specifically to address the fees. Following a roughly half-hour executive session in which the board received legal advice by phone from town attorney Bo Nerlin and attorney Nicholas Poppe, trustees voted, 4-0, to accept a settlement offer from Brunner's attorney, William Fritsche, in the amount of $30,000. Trustees also approved full payment prior to the end of the calendar year.
Trustees Bill Bear, Chelsea Bookout, Karen Budinger and Dave Knutson voted in favor of both motions; trustees Mary Bachran and Samira Hart were both absent from the special meeting.
